Acceptance of Terms
By accessing or using the services provided by landscylip B.V. ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services. These Terms apply to all users of our cloud hosting services, website, and related platforms.
Description of Services
landscylip provides cloud hosting services including but not limited to VPS hosting, dedicated servers, managed cloud solutions, and related technical support services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to customers.
User Obligations and Acceptable Use
As a user of landscylip services, you agree to:
- Provide accurate and complete information when registering for services
- Maintain the security of your account credentials
- Use our services only for lawful purposes
- Comply with all applicable laws and regulations
- Not engage in activities that could harm our infrastructure or other users
- Not use our services for spam, malware distribution, or illegal content
- Respect bandwidth and resource limitations outlined in your service plan
Payment Terms and Billing
Payment for services is due in advance according to the billing cycle selected. We accept various payment methods as specified during the ordering process. Late payments may result in service suspension. You are responsible for all taxes and fees associated with your use of our services.
Intellectual Property
All content, software, and materials provided by landscylip, including our website, control panels, and proprietary technologies, are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary materials without explicit written permission. You retain ownership of content you upload to our services.
Data Protection and Privacy
We are committed to protecting your privacy and personal data in accordance with applicable data protection laws, including GDPR. Our Privacy Policy, which forms part of these Terms, details how we collect, use, and protect your information. You are responsible for ensuring that any personal data you process using our services complies with applicable privacy laws.
Service Level Agreement
We strive to maintain high availability for our services and offer uptime guarantees as specified in your service agreement. Service credits may be available for qualifying outages as outlined in our SLA documentation. Planned maintenance windows are excluded from uptime calculations.
Limitation of Liability
To the maximum extent permitted by law, landscylip shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption. Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount paid by you for the specific service in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless landscylip, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
Termination
Either party may terminate the service agreement with appropriate notice as specified in your service contract. We reserve the right to immediately suspend or terminate services for violations of these Terms, non-payment, or illegal activities. Upon termination, you are responsible for retrieving your data, as we may delete data after the termination period specified in your agreement.
Backup and Data Recovery
While we implement backup procedures for our infrastructure, you are ultimately responsible for maintaining your own backups of critical data. We recommend regular backups and testing of recovery procedures. landscylip is not responsible for data loss, regardless of the cause.
Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to users via email or through our website. Continued use of our services after notification of changes constitutes acceptance of the modified Terms.
Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. If you are a consumer resident in the EU, you may also have rights under your local consumer protection laws.
Dispute Resolution
We encourage resolution of disputes through direct communication. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute, unless prohibited by applicable law.
Force Majeure
landscylip shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, or network failures by third-party providers.
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and landscylip regarding the use of our services and supersede all prior agreements and understandings.
